What should I do if I had and accident while driving without an auto insurance?

I had an accident but my insurance was expired. I had no fault for the accident. A lady did not stop at a stop sign and crashed into my car. She called the police and they filled an accident report. I don’t know if the police officer realized that my insurance was expired because he did not say anything to me. He just told me to go pick up the police report in 5 days to the police station.
Now I don’t know in how much trouble am I? What penalties are for me? Can I get money to fix my car from the other person’s insurance? What can/should I do to fix this mess?
Any advice is really appreciated it.

The other person (if they are at fault) has to fix your car (their insurance does).

You have to file a report with DMV (if in California) if the damage is over a certain amount. Look this up on the DMV web page. There is a form there you have to complete.

Don’t settle with the insurance company unless you get fully compensated (get the car fix). Don’t let them intimidate you because you did not have insurance.

If you have bodily injuries, see a doctor.

As far as not having insurance ? I think you can get in trouble for that. I am not sure what the penalties are.

    Peace.

You could have received a ticket for failure to carry insurance. Count yourself lucky that you didn’t. Find out what it will cost to repair your car, and contact the insurance company of the at fault driver and make a claim. You won’t have your own insurance to help you through the process. Of course you should also make sure you now have valid insurance, even though it won’t help you for this one.

I’ve had this happen before. It doesn’t matter if you had insurance or not, or if it is legal or not in your state. I just called my expired insurance provider, reported the accident to them and renewed my insurance at the same time. Let them know it was not your fault. Let your insurance provider you just renewed with investigate, and ask them what to do about your situation. Definitely tell your insurance provider that you have a police report and you will be fine. Ask them about your DMV obligations, and they will say they will appraise the damage to your vehicle and go from there.

I’ve been hit by a man without insurance, it was his fault, and he subsequently purchased insurance and let them handle it with my insurance. I’ve been hit, it wasn’t not my fault, and had not renewed my insurance. I just called my insurance, told them I was hit, I had a police report showing it was the other driver’s fault, they renewed my expired policy & took care of everything.

I have no sources to cite; this is from experience. I’ve found when dealing with a situation like yours, time is of the essence. You need to do what I did: get in touch with your old provider right away. The saying that applies in this situation is: “Ain’t nothin’ to do but to do it!”

You can start off by getting insured immediately, then let your insurers know about the accident, specifying that you have a police report and that if was the other person’s fault.

I find the best car insurance by getting quotes from running two comparison tools:
